1. Agreement to Terms

By downloading, installing, or using the Desk Dojo mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legally binding agreement between you and Desk Dojo ("we," "our," or "us") governing your use of the App.

2. Eligibility

You must be at least 13 years old to use the App. By using the App, you represent and warrant that:

  • You are at least 13 years of age
  • You have the legal capacity to enter into these Terms
  • Your use of the App does not violate any applicable law or regulation

If you are between 13 and 18 years old, you represent that you have your parent or guardian's permission to use the App.

3. Account Registration

3.1 Account Creation

You may use certain features of the App as a guest without creating an account. To access all features and sync your progress across devices, you may create an account using your email address.

3.2 Account Responsibilities

If you create an account, you are responsible for:

  • Providing accurate and complete registration information
  • Maintaining the security of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized use of your account

3.3 Account Termination

You may delete your account at any time through the App settings or by contacting us. We reserve the right to suspend or terminate your account if you violate these Terms.

4. Use of the App

4.1 License Grant

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App for your personal, non-commercial educational purposes.

4.2 Prohibited Uses

You agree not to:

  • Copy, modify, or distribute the App or its content without our permission
  • Reverse engineer, decompile, or disassemble the App
  • Attempt to bypass any security features of the App
  • Use the App for any illegal or unauthorized purpose
  • Interfere with or disrupt the App or servers connected to the App
  • Use automated systems (bots, scrapers) to access the App
  • Impersonate any person or entity
  • Share your account credentials with others
  • Use the App to harm minors in any way

5. Intellectual Property

5.1 Our Content

The App and its entire contents, features, and functionality (including but not limited to all lessons, quizzes, text, graphics, logos, icons, images, audio clips, and software) are owned by Desk Dojo and are protected by United States and international copyright, trademark, and other intellectual property laws.

5.2 Trademarks

"Desk Dojo" and our logo are trademarks of Desk Dojo. You may not use our trademarks without our prior written permission.

5.3 Third-Party References

Microsoft Excel and related trademarks are the property of Microsoft Corporation. Google Sheets is a trademark of Google LLC. We are not affiliated with, endorsed by, or sponsored by Microsoft or Google. References to Excel and Google Sheets are for educational purposes only.

6. Educational Content

6.1 Content Accuracy

We strive to provide accurate and up-to-date educational content. However, spreadsheet software is frequently updated, and we cannot guarantee that all content reflects the latest versions of Excel or Google Sheets.

6.2 No Professional Advice

The educational content in the App is for general learning purposes only. It does not constitute professional advice. You should always verify formulas and techniques in your actual spreadsheet software before relying on them for important work.

6.3 Certificates

Certificates earned through the App represent completion of our educational content. They are not accredited certifications and should not be represented as such.

7. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

  • The App will be uninterrupted, secure, or error-free
  • Any errors or defects will be corrected
  • The App is free of viruses or other harmful components
  • The results of using the App will meet your expectations

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL DESK DOJO, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP.

Our total liability for any claims arising from your use of the App shall not exceed the amount you paid us, if any, in the twelve (12) months preceding the claim.

9. Indemnification

You agree to indemnify, defend, and hold harmless Desk Dojo and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with:

  • Your use of the App
  • Your violation of these Terms
  • Your violation of any third-party rights

10. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms in the App or on our website and updating the "Effective Date."

Your continued use of the App after any changes indicates your acceptance of the modified Terms. If you do not agree to the modified Terms, you should stop using the App.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.

Any disputes arising from or relating to these Terms or your use of the App shall be resolved in the state or federal courts located in the United States, and you consent to the personal jurisdiction of such courts.

12. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

13. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Desk Dojo regarding your use of the App and supersede all prior agreements and understandings.
